Did the Police come since there was a motorcycle involved and that usually means injuries to the rider?
Did they cite her for failure to yield?
The pain and suffering you have is worth something ya know....
Glad you're okay relatively speaking. For the most part I detest most, not all, lawyers and have contempt for people filing frivolous lawsuits. However in this case I think you should sue unless there are facts heretofore unknown or if her insurance company settles with a generous sum. David
Does anyone know if I should also make a claim with my insurance (Progressive) or just let her insurance (USAA) take care of it.
There goes my 20+ year spotless history of riding motorcycles.
I always knew it would be a matter of "when" not "if", so today is the day.
I was about 2 blocks from work at an intersection that the cross traffic street has to stop at. The street I was on doesn't stop and is a 35-mph zone. It has a blind corner into this intersection and I always anticipate people not stopping and/or not seeing or looking and have been cut-off at this intersection more times than I can count.
I saw this lady in her mini-van stop at the sign and then moved 4-5 feet forward and stop again, which is the only way to see around this blind corner. When I saw her stop the first time and started to move forward I started to slow down to about 20. Then when she stopped the second time I "assumed" she saw me and was stopping for me, WRONG!
She pulled out right into me and broad sided me, after that things got a little blurring and all I remember is watching the left side of my bike hitting the cement, bounced back up and rolled ghost rider style down the road. Mean while I'm flipping through the air and must have landed on my head and shoulder and rolled into the sticker bushes and stinging needles.
Yea, I think I went in to a tuck and tumbled down the street.Since you landed on your shoulder/head, Did the shoulder armor(assuming you had some on) protect the entire impact area or no?
No, that was first time this year I hadn't worn them.Were you wearing boots?
There was a time shortly after the impact that I can't recall up until the time that I was being told not to move. I'm guessing 30seconds to a minute.Did you keep consiousness during the entire event?
No, I never went into shock. The EMT's checked me out blood pressure was normal and I was coherent and refused to go to the hospital.Did you feel yourself going into shock?
Yea, that would have saved most of the damage for sure. Of course now I'm probably getting a new bike! :thumbup:If you had it to do over again would you have frame sliders?
Not really, there was only a small scuff on my jeans.And would pants have helped in this instance?
Do you work for USAA? Just kiddin, no, I kept moving afterwards, so that helped a lot, but the next morning was rough.When you got home and had calmed down, sitting there as your body started to stiffin up, your adreniline returning to normal did you either A. Eat a ton of food or B. Fall asleep..

Yea, I guess I had it coming because I was little arrogant about how I've been riding for awhile without an accident.I know my time will come, not a matter of if as you say, just a matter of when..
You need to notify your insurance of the accident, then let them handle it with her insurance.
So I wonder if the insurance company can rent a motorcycle for me. Hmm....
